PaintSure – Terms & Conditions

These Terms & Conditions govern the use of PaintSure’s services and website.
1. Overview
PaintSure provides subscription-based interior paint maintenance services for residential, commercial, and industrial properties. By using our services, you agree to these Terms & Conditions in full.
2. Service Scope

Interior paint touch-ups and minor repairs only.
-
External paintwork is excluded and quoted separately if required.

Full repaints are not included in the subscription and will incur additional charges.
3. Eligibility for Service

Maintenance services are available once every 12 months, unless otherwise agreed upon.

If service is required before the 12-month period, the full annual subscription fee minus any payments already made must be paid upfront.

Emergency or urgent work after a completed annual service may incur additional costs.
4. Membership Terms

Services can commence when:
â–¸ Your membership has been active for 12 continuous months, or
â–¸ The full annual payment (minus any months already paid) has been made upfront. -
Clients are responsible for maintaining an active membership.

Missing two consecutive monthly payments will result in automatic membership cancellation.

Cancelled memberships are not eligible for services, and no refunds will be issued for previous payments.
5. Property Type & Size
-
PaintSure services are available for residential, commercial, and light industrial buildings.
-
Properties exceeding 50 squares (approx. 465 m²) in size will:
â–¸ Not be covered under standard subscription plans,
â–¸ Require a custom quotation, and
â–¸ May incur additional costs before approval. -
Properties with additional structures (detached or attached buildings such as granny flats, offices, or studios) will not be included in the subscription unless:
â–¸ Approved in advance, and
â–¸ A custom tier has been provided to cover all structures.
6. Refunds & Cancellations
6.1 Cancellations by Customer

You may cancel your membership at any time.

If no maintenance has been completed, you may cancel your membership; however, no refunds will be issued for prior payments.

If services have already been completed, no refunds will be provided.
6.2 Missed Payments

Missing two consecutive monthly payments will result in automatic cancellation.

Cancelled memberships are not eligible for services unless re-subscribed.

No refunds will be issued for any previous payments in the event of cancellation.
6.3 Early Maintenance Bookings

Maintenance visits can only be booked once every 12 months.

If early service is required, the full annual subscription fee minus any monthly payments already made must be paid before any service can be scheduled.

Additional or emergency bookings after a service has been completed in the same year may incur extra charges.
7. Service Limitations
PaintSure reserves the right to refuse or postpone service if:

The membership is inactive or overdue.
-
The job exceeds the agreed scope of work.
-
The premises are unsafe or not adequately prepared for paint maintenance.

8. Paint & Colour Matching
PaintSure uses premium-quality, commercial-grade paints. While efforts are made to match existing colours, slight variations may occur due to aging and prior conditions.
9. Warranty and Limitations
PaintSure offers a 12-month workmanship warranty on all completed internal touch-up work. This warranty excludes:

Structural issues

Water damage or leaks
-
Renovation-related changes
-
External weathering or third-party work
10. Emergency Services
Emergency callouts are not included in standard plans and will be charged separately based on urgency, scope, and site access.
11. Liability and Insurance
PaintSure maintains all required public liability and workers’ compensation insurance.
We are not responsible for:

Delays outside of our control (e.g. weather, access issues)

Indirect, incidental, or consequential losses
12. Site Conditions and Access
Clients are responsible for:
-
Providing safe, reasonable access to the property

Informing PaintSure staff of any hazards or limitations
-
Notifying PaintSure in advance if additional structures require service
Unsafe or restricted conditions may result in a delay or rescheduling.
13. Dispute Resolution
Disputes will be addressed through written correspondence first. If unresolved, formal mediation will be the next step.
14. Governing Law
These terms are governed by the laws of the State of Victoria, Australia.
15. Intellectual Property
All content, branding, and materials displayed on PaintSure’s website are the property of Bicolour Painting and Maintenance Pty Ltd and may not be used or reproduced without prior written consent.
16. Limitation of Liability
PaintSure and Bicolour Painting and Maintenance Pty Ltd are not liable for:

Damage not caused by our services.

Delays due to weather, site access issues, or client unavailability.

Issues outside the scope of paint maintenance.
